Newsletter

Dear Lucie

I am pleased to announce that the IBSA will hold an annual international tax course for junior employees of our corporate members.  It will be a mid-summer two day 12 point CPD accredited course in central London and will be based on the MA course I gave at the University of London over the past 5 years.  The course revolves around the development of a domestic company into a global icon and analyses the stages of its growth, which is indeed similar to the approach we are taking for the 18 November 2016 conference at the Landmark hotel, London as per the details below.  Intermediate corporate members will be entitled to enrol one employee free of charge, whilst full corporate members will be entitled to enrol 3 employees free of charge.

This reflects the continuing ambition I have for the IBSA, namely asking experienced members to act as ‘mentors’ for younger professionals, as well as engaging these younger professionals in the IBSA and assisting them in creating a contact base with professionals around the world, who perhaps have different disciplines than their own.  We are happy to take registrations now for the 2017 course.

This busy autumn for the IBSA started with a very successful discussion group on Investing in UK real estate and the effect that Brexit will have on the real estate market.  It was held at Howard Kennedy with 76 registrants listening to experts from Savills, Howard Kennedy, Charter Tax and IFS; a summary of the evening’s presentations is on our website.  The Article on real estate shown in this newsletter is from Dmitry Zapol, one of our presenters at Howard Kennedy, and reflects his experience of what overseas investors are concerned about when investing in high end residential property.

We will then have two launches in October, the first in Dubai on 18th October launching the Middle East branch of the IBSA to be held at the Capital Club, Dubai, and the second in Cyprus on 20th  October to be held at the Londa Beach hotel, Limassol.  Both launches will take the form of a structured discussion group, followed by networking drinks and canapes. Please click on the link below to register for either of these events.  On 17th November, we are having our Members' Annual Dinner at 'The Hall of Fame', Langan's Brasserie, London - we would be delighted if you could join us as the evening offers the opportunity for all IBSA members to meet in an informal and relaxed setting over good food and wine - what could be better!  Lastly, on 18th November, we are holding our Annual IBSA Conference, the theme this year is 'Guiding the Development of the SME Clients' - please see below for more information. We hope to see you there -  it promises to be an exceptional conference.  Details of all upcoming events are on our website or you can register attendance by the links below.

As I said in my last newsletter, we all want to encourage our younger professional colleagues to join the IBSA and take responsibility for its future, their future, by joining local committees to develop local branches.  We would also welcome new membership of the IBSA global committee to create and achieve the strategic ambitions of the IBSA. If you would like more information about the IBSA and are interested in joining our Association, or if you are already a member but would like to join a local or the global committee, please contact Lucie.Hoyland@istructuring.com .

Kind regards,

Conference

Guiding The Development of SME Clients,

18th November 2016, 09:00

The Landmark Hotel, London

The IBSA has been very proud of the quality of speakers and topics at its annual event, the IBSA November conference.  This year it will be held again at the Landmark hotel, London.  The theme of the conference is how a SME develops its international business with the help of those professional advisers engaged in the various issues which they will face – from intellectual property issues to financing arrangements and even the creation of a brand manifesto and digital strategy that will be required in today’s markets.

Expert speakers reflect the range of disciplines which the IBSA recognises are essential for guiding the development of the SME, and are from the US, UK and several Continental European jurisdictions. We have included VAT experts to advise on the pitfalls the SME may face and transactional lawyers to help the SME develop joint ventures, franchising and licensing arrangements with overseas third parties.  Roy and others members will cover the international tax issues they will face, as well as considering potential exit strategies for the entrepreneur behind the SME.

The programme is shown on our website.

Please visit our website for a programme of the day's event.  There are 6 hrs of CPD accreditation for this conference.

In the Pipeline for 2017

We are already working on events for the first half of 2017.

We will be holding a UK discussion group meeting titled 'Corporate Incentives to Employees and Investors', kindly hosted by Frank Hirth in January.

In February, our European branch will be running a discussion group titled 'Residence Planning for Business Owners', which will be held in Geneva.

In March, we are organising a combined UK/US discussion group, held in the offices of Squire Patton Boggs, London with video conferencing with our US branch in New York titled 'US and UK Tax Consequences of BEPS and State Aid'.

IBSA for younger professionsals - we would like to attract the junior employees to the association by holding an annual course on International Tax Planning/Business Structuring, in June, held at Squire Patton Boggs, London.  We will be having an informal evening get-together earlier in the year for junior associates where we will introduce the Polycon case study June course and they can meet prospective students.

We will keep you posted on the above events in due course.

DEVELOPMENTS IN UK REAL ESTATE TAXATION IN RECENT YEARS

Dmitry Zapol, IFS Consultants

For decades, the UK has welcomed overseas investors with interests in residential and commercial properties with its benign tax regime. Admittedly there had been a few mildly irritating snags: an increasingly high stamp duty land tax (SDLT), unavoidable taxation of rental income, and inheritance tax issues. These may have been mitigated with the help of foreign property owning companies and various debt instruments, whose costs were dwarfed by the ensuing benefits. However, the main advantage lay in the absence of taxation associated with ownership and disposal of UK real estate by non-residents. Read more >>

UK REAL ESTATE MARKET

Simon Aldous, Savills

My summary contains some wide generalisations and covers the residential market, in particular prime London in more detail than the commercial sector.  We have in the past 18 months and, in particular after the significant stamp duty changes from the autumn statement in December 2014, seen the prime housing markets across the UK fall in value.  The referendum vote has added further caution across all the prime London residential markets. THE LIONEL MESSI "IMAGE RIGHTS" CASE

Robert Kiggins, Culhane Meadows

Recently a Spanish Court found the famed Barcelona soccer (football to most of the world) striker, Lionel Messi, and his father, Jorge, guilty of criminal tax fraud. While the Court stopped short of sending either of them to jail, substantial monetary penalties were imposed on the pair.   The case was an image rights transfer gone bad. Read more >>
