Dear Member

Following the success of our last workshop  on 12th April on ‘International Tax Disputes’, we are looking forward to next week’s workshop on ‘The Business of Sport and Entertainment’ to be held on the morning of 22nd June at Saffery Champness office.  The programme is on our website, and I am sure that any professional advisor involved with sports personalities or entertainers will find this workshop invaluable.  Among the presenters will be Patrick Way QC plus professional advisers and commercial experts conversant with the various issues encountered when planning the career and engagements of these individuals. I have written an extensive article summarising the issues involved which need to be addressed and this can be found on the website as can be seen below in the Articles section of this newsletter.  And please don’t forget that we welcome articles from all members which we will feature on our website and send out in our monthly newsletters.

Our discussion groups are always entertaining and informative, and last month’s meeting at Close Brothers was on the Business of an International Family Office.  Dmitry Zapol has written a summary article based on this event which is featured in this month’s newsletter below. The next meeting of the UK branch of the IBSA will be after the summer on September 20th on the topic of ‘Investment in UK property and Business Investment Relief’. There is also a meeting planned for the North American branch in New York a week later on 28th September – more about this and other branch meetings in the next newsletter.

Finally, a note for your diaries please.  Our annual members’ dinner will be held this year on Thursday evening November 17th in the Hall of Fame private dining room at Langan's Brasserie in London, the night before our annual conference on 18th November entitled ‘Guiding the Development of an SME Client’.  The programme for this conference is now on our website under Events and registrations are open for the conference and the annual members’ dinner as directed.

We are now just 8 days away from the EU Referendum and I hope the decision reflects your own preference! I also hope that you enjoy a great summer of fine weather, food and wine and look forward to seeing you all again in the Autumn.

Kind regards,

Roy

Workshop

Saffery Champness, 22nd June, 09:00

Sportsmen and Entertainers are highly paid individuals whose careers sadly often last only for a few years.  In that time, they need to maximise their earning capacity through contractual arrangements involving their performance, image rights, merchandising and endorsement appeal amongst others.  At the same time they need to contribute towards pension and other financial arrangements to provide funds for an early retirement. Tax authorities around the world have targeted both sportsmen and entertainers within the same bracket by limiting deductible payments for retirement, whilst ensuring that even minimal time spent in a particular jurisdiction attracts the maximum amount of tax.

This workshop considers the business of sport and entertainment by analysing the issues through a case study approach of a typical footballer and a highly successful female singer.  We will review the various types of contracts that the individual may be invited to enter into, the legal complications surrounding some of the typical provisions within such contracts, and the ability to register image rights and other intellectual property rights to maximise earnings.  A commercial agent from an image rights company will discuss his experiences whilst our experienced barrister in this field will reveal the issues he has resolved with HMRC in connection with the taxation of entertainers and sportsmen.

THE BUSINESS OF AN INTERNATIONAL FAMILY OFFICE

Dmity Zapol, IFS Consultants

A family office is often found in the list of affluent lifestyle’s attributes together with a yacht, a jet and a Swiss boarding school tie. Yet on closer inspection, out of these and similar objets du désir a family office serves a much greater practical purpose — that of nurturing and augmenting wealth and putting it under control of dedicated professionals. At the IBSA’s last discussion group hosted by Close Brothers on 24th May 2016, four distinguished speakers offered their practical views on the nature of family offices and their effective application.  Read more >>

This article will summarise the principal considerations to be borne in mind when structuring international arrangements involving entertainers and sportsmen and the special tax regimes applicable to these arrangements.   Read more >>
